1. Agreement to Terms

By accessing or using Thoughtmarks ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1.1 Eligibility

  • Must be at least 13 years old
  • Have the legal capacity to enter into binding contracts
  • Not prohibited from using the Service under applicable laws

2. Account Creation and Security

2.1 Your Responsibilities

  • Maintain confidentiality of your account credentials
  • Responsible for all activities under your account
  • Notify us immediately of any unauthorized access
  • Use a strong, unique password

2.2 Account Termination

By You: Delete your account anytime via Settings. All data permanently deleted within 30 days.

By Us: We may suspend or terminate accounts for violations. We provide 14 days notice unless immediate action is required.

3. License and Ownership

You retain all rights to your content.

Your content includes Thoughtmarks, notes, voice recordings, tags, and organizational structures you create.

3.1 Limited License to Us

By using the Service, you grant us a limited license to:

  • Store your content on our servers
  • Process your content to provide features
  • Backup your content for recovery
  • Display your content to you across your devices
This license is non-exclusive (you retain all rights) and ends when you delete your account. We will NOT use your content for advertising or marketing.

4. Acceptable Use Policy

4.1 Permitted Uses

  • Personal note-taking and thought organization
  • Voice recording and transcription
  • AI-assisted writing and research
  • Task management and productivity

4.2 Prohibited Activities

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful, offensive, or illegal content
  • Attempt to gain unauthorized access
  • Use automated systems without permission
  • Reverse engineer or extract source code

5. Subscriptions and Payments

5.1 Free Tier

  • Unlimited Thoughtmarks
  • Voice recording and transcription
  • Basic search functionality
  • Apple Watch integration

5.2 Premium Subscription

  • Advanced AI features
  • Cloud backup and sync
  • Unlimited voice recording length
  • Priority support

5.3 Billing

  • Subscriptions billed monthly or annually
  • Payment processed through Apple App Store
  • Cancel anytime
  • 14-day refund for EU customers

6. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

6.1 Limitation of Liability

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to amounts paid in the past 12 months
  • We are not liable for loss of data, profits, or business opportunities
Some jurisdictions do not allow these limitations, so they may not apply to you.
